Agreement,

contracting through Price Rubin &
Partners (Artist's
Representative).
Artist
is the responsible principal to Local
Manager. Price Rubin & Partners
signs the agreement only as
Artist's
Representative
and is not obligated and is not responsible for any acts or
defaults of the Artist discussed in
Section 8.
1)
Artist will
perform at ____________________, whose seating capacity is _____ ,

unless otherwise specified.
a)
Artist
requires two hours of practice on the concert instrument, two
hours prior to each service.
2)
Local Manager
will furnish, at its expense, complete facilities, services and
personnel customarily furnished in a concert of this kind,
including without limitation, the following:
a)
A suitable theater, hall, auditorium or
other place of public assembly which will be well-heated or cooled
(72 degrees F), as the case may be, properly lit, clean and in
good order, and which will contain a clean, comfortable dressing
room near the stage for Artist.
b)
An adequate staff of necessary personnel
including box office, ticket takers, ushers, electricians, stage
hands, and if necessary, special guards, attaches or police.
3)
Artist
agrees to furnish a copy of biography and photographs for the
program, which is to be printed and distributed by Local
Manager. Local Manager
agrees to print the copy in its entirety.
4)
No seats will be permitted on the stage
without the consent of Artist.
5)
No radio or television apparatus,
filming, recording or transmitting device shall be used during the
concert in any manner to reproduce
Artist's
performance without prior written consent of
Artist.
6)
No later than noon of the day scheduled
for the performance, Local Manager
will pay to North American Artists
Foundation the sum of $___________
(Honorarium) plus air (coach fare) meals and
hotel. Tax identification number is
#742542564.
7)
Artist
shall have the right not to perform aforementioned concerts
hereunder, without liability to Artist or
Artist's
Representative if:
a)
Local Manager
fails to comply with all the terms and conditions applicable
herein, in which case Local Manager
may also be liable for any damages resulting therefrom, or
b)
Prior to the date of the scheduled
concert, Local Manager fails,
neglects or refuses to perform any contract with a different
artist, through no fault of such artist, or
c)
Prior to the date of the scheduled
concert, it is discovered that financial credit of Local
Manager is impaired, or it otherwise appears likely
that Local Manager is unable or
unwilling to meet financial commitment herein, or
d)
Artist is
unable to appear because of physical disability, labor
difficulties, strike, civil tumult, acts or regulations of public
authorities, epidemic, interruption or delays of transportation
service, acts of God, or any other causes beyond
Artist's
control.
8)
This contract shall be signed and
returned to Artist's
Representative within 14 days after its issuance
date, or Local Manger must confirm,
by fax, a written commitment for the engagement and indicate the
final processing date for the contract.
Failure to explain any delays for the return of the
contract can result in a withdrawal of the offer extended by
Artist's
Representative on behalf of
Artist.
9)
This agreement constitutes complete
understanding with respect to the subject matters contained herein
and Local Manger may not assign or
transfer it without written consent of
Artist's
Representative. All
notices hereunder and all other communications to
Artist will be given in writing and
addressed to Price Rubin & Partners at 220 W. Pershing Ave.

All advertisements and house programs
must carry the following line directly beneath
Artist's
name: "by
arrangement with Price Rubin".
11)
ROYALTIES OR PERFORMING RIGHTS FOR MUSIC
USED IN CONNECTION WITH THIS CONCERT(S) ARE TO BE PAID BY
ORCHESTRA. NUMBERS TO BE PERFORMED
BY "ARTIST"
ARE TO BE MUTUALLY AGREED UPON BY THE PARTIES HERETO.
ORCHESTRA WILL SUPPLY ALL MUSIC MATERIALS FOR
COPYRIGHT AND NON-COPYRIGHT SELECTION REPERTOIRE:
13) The
Artist is not allowed to appear
within a sixty (60) mile radius for six (6) months prior to the
appearance with the____________________.

as his only instruction for your engagement.
